Widgetop is a free web service and social networking site that enables Members to create a web desktop or unique personal pages online in order to privately use those web pages and external web services/content and to find, share pages and communicate with friends.
The services offered by Widgetop.com ("Widgetop.com" or "we") includes the Widgetop.com website ("Widgetop" or "website" or "Service") and any other features, content, or applications offered on the widgetop web site. The Widgetop Services are hosted in Germany.
By using the Widgetop.com web site you are agreeing to be bound by these following terms and conditions:
Widgetop reserves the right to update and change the Terms of Service from time to time without any prior notice. Any new functionality that adds to or enhances the current Service, including the release of new features, tools and resources are under the Terms of Service. Continued use of the Service after any such changes shall constitute your acceptance to use such changes and the current Terms of Service.
This Terms and Service constitutes our Terms and Conditions of Use Agreement ("Agreement") which sets forth the legally binding terms for your use of the Widgetop Services. By using the Widgetop Services, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Widgetop Website) or you are a "Member" (which means that you have registered with Widgetop.com) or you are a "Developer" (which means that you create and submit widgets to be hosted by Widgetop and be made available to other users).
The term "User" refers to a Visitor, Member or Developer. You are only authorized to use the Widgetop Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and save it. If you do not agree with it, you should leave the Widgetop Website and discontinue use of the Widgetop Services immediately. If you wish to become a Member or Developer, communicate with other Members and make use of the Widgetop Services, you must read this Agreement and abide by it.
The Service is provided on an AS IS and on an AS AVAILABLE basis. Your use of the Service is at your sole risk. Widgetop does not warrant that the service will meet your own requirements and has no responsibility and liability for the availability, timeliness, security or reliability of the Service. Widgetop also reserves the right to update, change, augment, suspend or discontinue the Service with or without notice to you at any time and without any liability.
You acknowledge that Widgetop owns all intellectual property rights of the service it is providing. Widgetop hosts widgets provided by developers and as such copyright ownership for each widget is held by the individual widget developer. You will not change, augment, adapt, reverse engineer or hack the Service. You may not reuse or modify portions of the widgetop service code to run another website or to host any portion of the service or to falsely imply that it is associated with an external Service. You agree not to reproduce, market, duplicate, copy, sell, resell, lend, rent or exploit or disclose technical information about any part of the Service, use of the Service, or functionality or access to the Service without the express written permission by Widgetop.com
The service is for non commercial use by individual users only. You agree not to share your account or password with other users. You agree not to sell or otherwise transfer your profile to another user. You are responsible for maintaining the secrecy and confidentiality of your account password and are responsible for all activities that occur for that registered account and the content on its published pages on the Service. You must be older than 14 years to use the Service. Accounts must be registered by the user. It is not permitted to register accounts by automated programs, scripts or bots. It is not permitted to use the service with any automated program, script or bot to manage or control the service. You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations. You shall not enable or encourage any third party to use the Service for any inappropriate or fraudulent purposes. You shall not interfere with, disrupt, or create an undue burden on the Widgetop Services or the networks or services connected to the Widgetop Services.
You understand that the technical processing and transmission of the Service, including your content, may be transferred unencrypted or encrypted and involve the transmissions over various networks and so your content may be changed to conform and adapt to the technical requirements of connecting software, networks and hardware together to form the Service.
Third party widgets are used by the Service and so may be provided by a registered Developer. Widgets submitted by a developer may contact untrusted Web sites, and as such can pass on any sensitive information that you provide them with. Widgets are able to access multiple Web sites at the same time, including sites on your local intranet. You should not download and use widgets from Developers that you do not trust. Widgetop cannot be held responsible for any problems caused by or the poor service of Developer created widgets hosted by the service. However should any problems arise the said widget can be removed from the Service and so users may report any problems they noticed to support@widgetop.com. Please state "third party widget problem" as part of the subject heading and provide all relevant details of the widget in the email.
Illegal and/or unauthorized use of the Widgetop Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Widgetop Website is prohibited. Using the Service to send viruses or use of hacking scripts or other similar nefarious or anti social sabotage are not prohibited and once noticed will be immediately removed by Widgetop and the users account suspended. Widgetop cannot be held responsible for any such activity or damages caused by other users activities, either done intentionally or accidentally. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member pages without notice and may result in termination of Membership privileges of their account. Appropriate legal action will be taken for any illegal or unauthorized use of the Widgetop Services.
This Agreement shall remain in full force and effect while you use the Widgetop Services or are a Member. You may terminate your Membership at any time, for any reason and remove your account. Widgetop.com may terminate your Membership at any time, without warning and remove your account for any reason. Even after Membership is terminated, this Agreement will remain in effect.
These Terms and Conditions will be governed by and are in accordance with the laws of the United Kingdom.
You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights.
It is the policy of Widgetop.com to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of prompt notification to Widgetop.com by the copyright owner or the copyright owner's legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the Widgetop Services in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: (1) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (2) a description of the copyrighted work that you claim has been infringed; (3) a description of where the material that you claim is infringing is located on the Widgetop Services; (4) your address, telephone number, and email address; (5) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (6) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. Widgetop.com's Copyright Agent for notice of claims of copyright infringement can be reached by email: support@Widgetop.com. Please put "copyright agent notice" as the subject heading in correspondences.
Widgetop takes no responsibility for users own personal content or external third party content. Widgetop does not have any obligation to monitor such users content or external third party content. We may remove content if noticed or are notified about, or remove accounts containing content that we determine in our sole discretion are unlawful, offensive, threatening and objectionable or infringes on the copyright ownership from any third party.
Please choose carefully the information you post on Widgetop.com and that you provide to other Users. Your Widgetop.com pages may not include content or photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Despite this prohibition, information provided by other Widgetop.com Members may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and Widgetop.com assumes no responsibility or liability for this material. If you become aware of misuse of the Widgetop Services by any user, please contact support@widgetop.com with "copyright abuse" as the subject field to report it.
Developers may upload and publish their personally created widgets for use by Widgetop users. Developers must ensure that all widgets they publish are free from any copyright ownership and that they have the right to publish the widget.
Developers are responsible for all content associated with the widget that originates from third party web sites which they specifically link to and make use of content from.
Widgets that infringe on copyright or make use of inappropriate content may be removed and developer account suspended. Developers are required to ensure that their widgets are developed in a user friendly way and so make efficient use of network and local widget storage. Widgets not complying with this policy may be removed from the Service.
Developers are responsible to ensure that their widget are fully tested, bug free and stable and only the original developer may submit updates to their deployed widget version if they find problems or add features to their widget on an as needed basis.
Developers should ensure that newly updated widgets deployed are compatible with previous versions so existing user don�t loose data, or consider deploying widget as a new version.
Developers may not capture passwords for users accounts on other Services or for which the Developer is not responsible for. All users personal information will remain private for the user. Widget developers may not use spyware or other similar techniques to monitor or gather information on users activities for advertising or other purposes.
Widgetop will review and release widgets to users after a testing period, but make no guarantee as to how long this will take or that the submitted widget will be accepted. Acceptance and publishing of widgets to end users is at the sole discretions of Widgetop. Developers may request that their widget be removed from the service by sending an email to support@widgetop.com with "remove deployed widget" in the subject heading and a description of the widgets details.
If you use our referral service to tell a friend about widgetop or to share your pages with them then we will ask you for your friends name and email address. We will automatically send your friend an email inviting him or her to visit the site once only. We store this information for the sole purpose of sending this one-time email and tracking the success of our referral program. You or your friend may request that we remove this information from our database by contacting us at support@widgetop.com and state "remove from referral service" in the subject field.
You agree to indemnify and hold harmless Widgetop and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature.
